It bothers me how DW is becoming more and more of a brand for commercial interests than it is a medium for good storytelling. The fact that the Daleks have appeared every year since the revival tells me that the Cardiff team is more intent on merchandising than they are with using the Daleks effectively in the episodes they're featured in. It's all part of that sad logic in marketing where if something works you keep churning it out, with little to no alteration, until people get sick of it. No, both are very wrong. (Remember that RTD had another alternative script for "Dalek" that would use the Toclafane, if the Nation Estate refused to give them the rights of use of the Daleks) It is due to the Nation estate, holders of the rights for the Daleks, which forces the BBC Wales to show at least one Dalek per season/series, or if no, they cancel the contract and the famous monsters never never appear again on the screen and, I believe, that all the Daleks episodes that appear in the new series will be deleted or censored unless they pay royalties to the Nation Estate. I'm no expert on licensing agreements, but I have a hard time believing that the Nation estate could have the power to retroactively remove episodes featuring the Daleks if BBC Wales were to temporarily retire them. Surely the estate would just sue if they're contract with BBC Wales were breached in away way, assuming of course that what you say is true and the Nation estate does have such a contract with BBC Wales in regard to yearly Dalek appearances.

Cheers Tony Not outright, I've seen quotes where Moffat and Co. are trying to make out as though they are debunking it, but I'm not sure if they ever really have.

I don't see the problem with one Dalek story every year anyway. It still leaves plenty non-Dalek stories.

This is one of those cases where you have to try really hard to interpret Moffat's words as not meaning the alleged contract clause does not exist.
And rest assured that even if the BBC lost the rights to use the Daleks that would have zero impact on any programme ever made (apart from possible arguments about new format media releases not covered by the existing contract), and I assume would have no impact on Big Finish either, who secured the rights to make Dalek stories five years before the BBC did.
